The superintendent of an Orchard Street apartment building is facing a felony charge, accused of tossing a cat from a fifth-floor fire escape on the morning of Sept 2.

Pedro Lopez-Clemente of 185 St. Joseph's Ave. was charged with aggravated cruelty to animals.

Detective Lt. Maureen Zadorozny, a police spokeswoman, said officers from the 4th Precinct were sent to 142 Orchard St. at 9:26 a.m. on a report of a man throwing a cat from a fire escape. When they arrived they saw Lopez-Clemente toss garbage from a fifth-floor fire escape, police said.

The officers found the seriously injured cat on the ground under the fire escape.

The animal was taken to the Yonkers Animal Shelter. The superintendent was arrested.
