Officials from the Fulton County Society for the Prevention of Cruelty to Animals seized 22 cats and two dogs from Fayne Burke's Old State Road residence after receiving a complaint in October 2004.

Of those animals, nine cats were euthanized because of health problems. Three of the cats remain in county custody, while the others were placed in foster care as Burke awaited trial.

The organization's attorney, Brian Toal, sought to recoup nearly $15,000 from Burke that was used to care for the sickly animals.


Case Updates

An elderly Johnstown woman who was awaiting trial in a publicized animal abuse case was struck and killed on Route 29 on the morning of Sept 3, 2005 by a driver who investigators said was under the influence of prescription drugs.

Fayne Burke, 80, of Johnstown was crossing the roadway on her way to Barbara's Garage Sale: Glorified Junk business, when she was hit by a Toyota Camry driven by Robert Waite, 78, of Gloversville. At the time of the 9:58 a.m. accident, Waite was heading west about one-tenth of a mile from Sweet Road, just east of the Rockwood State Forest preserve.

Later this month, Burke was scheduled to go to trial on animal cruelty charges.
