On March 2, 2003 the defendant was in his ex-girlfriend's driveway. She had a valid injunction against harassment in effect.

Upon arriving home, she saw the defendant removing three week old puppies from the garage. She cracked her car window and yelled to the defendant that he could not take the puppies, and that she was going to call the police. The defendant had two puppies in his hands at the time. The defendant threw one of the puppies over her house and into the adjoining neighbor's yard, she looked away as he threw the other.

Officers from the Phoenix Police Department arrived on the scene and found the two puppies dead.

Deputy County Attorney Anthony Church ensured that the defendant was convicted of two class six cruelty to animals felonies, and one count of interfering with judicial proceedings, a class one misdemeanor. The defendant was sentenced to two years of supervised probation, four months in the county jail, and approximately $10,000.00 in fines and fees.
