A pregnant black female pit-bull, named "Toothless", was found emaciated and lethargic. She was approximately 9 years old, and was discovered in a very small pen with no food or water.

A second pit-bull, a brown and white female named "Brownie", was also found emaciated and lethargic on a heavy 3 foot chain. Brownie was approximately 3 years old.

Both dogs were found in Mr. Smiths back yard with 4 other pitbulls. Mr. Smith reportedly stated over and over again that there was nothing wrong with his dogs. There was also a Jinney in the backyard, used for weight training the dogs. Mr. Smith stated to the judge that it was used to weight train his dogs for show.

Smith was found guilty of animal cruelty and was sentenced to a $1,000, 12 months in jail with 12 months suspended, and 5 years probation. He was also found guilt of failing to perform the duties of an owner, and was sentenced to 12 months in jail with 12 months suspended and 50 hours of community service.

Along with the cruelty charges Officer Gromlich also charged Smith with 6 counts of failing to have his dogs vaccinated against rabies, and he was found guilty on 3 counts for a fine of $50.00 each. Also 6 counts of faulure to license - he was found guilty on 3 counts and was fined $50.00 each.

Mr. Smith is also ordered to pay the City of Newport News a total of $1,244 for the boarding, medical and care for the dogs.

Toothless gave birth to 4 pups six days after Officer Gromlich seized her. Only 1 survived.

Brownie was adopted out to a loving home who had been waiting for 3 months to adopt her. Toothelss is now up for adoption with her puppy. They both need a loving home.
