A Puyallup man has been accused of animal cruelty after authorities said he tried to drown a kitten in a garbage can full of water.

Authorities have charged Donald Broeker with animal cruelty in the second degree, a misdemeanor punishable by up to 90 days in jail and a $1,000 fine, City Prosecutor Sherry Buchanan said.

Police reports said the kitten was inside a trap, which was lowered into the water. The lid was placed on the can. A brick was placed on top of the lid and the can was covered with a tarp and other material.

A neighbor who heard the kitten yowling rescued it. The kitten had just enough air between the lid and the water level inside the garbage can to breathe and howl.

Davidson said that she and her sister heard a cat meowing, but couldn't tell where it was. After realizing the voice was coming from Broeker's garbage can, Davidson removed a piece of plywood, raincoat and the tarp that covered the garbage can.

Broeker then came out, Davidson said, and helped her remove the tarp. Davidson then removed the brick and lid and found the kitten hanging on to the inside of the trap to keep its head out of the water, she said in her statement to police.

Davidson took the kitten inside her house and cared for it. She said she believed the kitten belonged to another neighbor. The kitten is now at the Puyallup animal shelter.

Connie Ellis, city animal control officer, said in the report that Broeker used to trap cats and call her to pick them up and take them to the shelter. Ellis said a neighbor once criticized Broeker because he trapped the neighbor's cat and turned it over to Ellis. The neighbor complained to Broeker that it cost him a lot of money to get his cat back, according to Ellis' report.

A pretrial hearing is scheduled for Nov. 19.
