Gerald Yates, 28, a Rikers Island jail guard was sentenced to three years' probation for dropping a co-worker's cat from a 9th floor window killing it.
Yates was also fined $730 and ordered to serve 70 hours of community service at an animal welfare organization by Judge Martin J. Schulman of Criminal Court in Queens.
Anne-Stewart Hamilton, spokeswoman for the American Society for the Prevention of Cruelty to Animals, said "We're very happy with the decision but I wouldn't want him working with us for 70 hours."
Yates did face up to a year in jail.
Yates was convicted in June 1992 of animal cruelty for dangling a cat out of the building in Far Rockaway on January 25. His co-worker, James Murray, begged him not to drop his cat Tigger. Yates dropped Tigger from the 9th floor inspite of Murray's pleading not to kill his cat.
He has been prison guard since 1984. Yates also faces a Department of Correction hearing where a review board will consider punishment ranging from a reprimand to loss of his job.
