An unidentified 17-year old teen was found guilty of cruelty to animals after the judge rejected his claim he was just joking about the bet and the cat fell accidentally.
The teen allegedly threw the cat out the fifth floor window over a $5 bet over whether the cat would land on its feet.
Youth court Judge Walder White conlcuded after a half-day trial. "The likely scenario is .... he deliberately threw the cat out the window. He made the bet, he went to the window with the cat, the cat fell to the ground."
The teen can't be identified because of the Young Offenders Act. The teen denied he threw the cat out. He testified he was just joking about it when the owner ran up to stop him and startled the cat into jumping on its own.
The nine month old cat named Philly shattered its two hind legs after the fall from the fifth floor window. Philly survived the fall but had to be destroyed.
The Judge orders psychiatric tests for the convicted teen.
