Scrappy a 17-year old long haired calico cat was kicked by a neighbor, Patrick J. Riley, 45, and died as a result of the abuse.

Riley has been charged with one count of cruelty to animals in the incident. A judge dismissed the charge without prejudice on Thursday.

Riley is currently serving a 120-day sentence at the Loraine Correctional Institution for violating his parole, he will face the animal cruelty charge when he's released in fourth months. Assistant City Prosecutor Kristin Wardell Maxwell plans to refile the charge.

When Riley was questioned on March 12, he admitted to kicking the cat but said the cat already appeared to be ill.

The 68 year old owner, Donna J. Speegle, said "She was just the sweetest. I can't get over it. She just had a personality."

It wasn't too often Scrappy wandered outside. It usually was to keep watch on Wallace Speegle, 75, as he worked in the yard. The two were inseparable. "Scrappy always sat with my husband. If he ate ice cream, she ate ice cream. If he went to bed, she went to bed."

Wallace Speegle said, "She couldn't breathe and her head just went down to the side." She lived about five more minutes.
