Glenn Smith shot a neighbor's dog after the dog attacked and killed his family's cat. Smith was convicted of a misdemeanor and fined 30 dollars.

Animal welfare advocates say prosecutors should have pursused felony charges. They mention the so-called T-Bone law -- which makes injuring or killing an animal a felony in some circumstances.

Franklin County prosecutors say they pursued the case as a misdemeanor after consulting the attorney general's office.
