Animals Seized for Neglect

Alleged: Michael Brown

Michael Brown, 38, owned the deceased American Quarter Paint horse in addition to a 7-year-old Paint horse that was found malnourished on his nearly five acre Spencer Terrace residence, said Precinct 5 Livestock Deputy Constable Marshall Williams.

Brown also owned a boxer dog and a macaw bird that were in okay condition but seized to get evaluated by a veterinarian, said Marshall, who added he had not been called out the residence before and this type of call is not common.

The ASPCA picked up the animals after Precinct 5 officers obtained a warrant following the discovery of the deceased horse.

"This is just a bad situation just all the way around," said Precinct 5 Constable David Hill.
"People just get out here in the country and don't realize what it is to take care of animals."

Brown was charged with cruelty to an animal and has a June 8 court date.

Cruelty to an animal is a Class A misdemeanor, unless the charged person has been previously convicted of the crime twice before, then it is a state jail felony. A Class A misdemeanor is punishable by a fine not to exceed $500. A state jail felony is punishable by 180 days to two years in jail and a fine not to exceed $10,000.
