A 41-year-old man was arrested and more than 100 fighting cocks were confiscated at a residence on the eastern edge of the city, said police spokesman Steve Davis.
Acting on a series of tips, police served a search warrant on 5335 W. Virginia Ave. at about 11 a.m. on May 23, 2005.
The man was arrested on suspicion of animal fighting, a felony.
Davis said the man was believed to be in the business of raising the roosters for cockfighting.
Ha Do said he leases the chicken pens behind the home to several tenants on the condition that they not break any laws. "The contract says they do not fight or do anything illegal in my place," Do said.
Do said he thought the birds may have been used for fights out of state.
"Whether or not fighting occurred there, we're not sure," Davis said. "Neighbors say, 'Yeah."'
Regardless, the animal-fighting statute encompasses breeding and housing, Davis said.
All, or nearly all, of the birds will be euthanized because of the condition they were in, Davis said.
The area is an older neighborhood in Lakewood. Davis said he wasn't sure if there are zoning laws or city ordinances governing having that many domestic birds on the property.
Case UpdatesHa Do, owner of the property, was booked and released while the Jefferson County district attorney decides whether to issue a felony summons for animal fighting. Do said no cockfighting ever took place on his property. He leases the pens to seven people who raise the birds, Do said. He has been trying to contact them, he said.
Do said he believes it is legal to raise and sell the fighting cocks as long as you don't fight them in Colorado. | Source: Denver Post - May 25, 2005 Update posted on May 26, 2005 - 1:46PM |
