Darryl Baldwin, 33, is charged with animal cruelty in the Oct. 10 slaying of Diamond, an 18-month-old poodle that belonged to a Warwick woman.
Police say Baldwin killed the dog in retaliation because the woman evicted him and his girlfriend from her Meetinghouse Road home following an argument. She found the dog's body in a small pond behind her home.
The dog's owner told police that Baldwin had threatened in the past to harm her pets. He was employed at a gas station around the corner from her house when the slaying occurred.
Diamond's owner told police she caught a glimpse of Baldwin fleeing her yard after the death of the dog. Defense attorneys argued last month that there was not enough evidence to go forward in the case, but a judge turned down their request to drop the charges.
Baldwin denies killing the dog. His trial was scheduled for late April before county Judge Rea Boylan, but was postponed due to another trial being held in the same courtroom.

Ann Rotondo testified that she heard her dog yelp in October, found it dead and caught a glimpse of Darryl Baldwin, 33, fleeing her yard. The Philadelphia man had lived in Rotondo's Warwick home with her niece for three months and was evicted shortly before the slaying.
But Baldwin testified that he was in Philadelphia playing video games with a friend when "Diamond," an 18-month-old black poodle, was killed.
