Defendant/Suspect: Mark Presnail
Mark Presnail was convicted of animal cruelty. He was sentenced to 90 days in jail, 18 months probation, a two-year ban on owning any pet and an order to get anger management counseling.
In March 1999 Mark reportedly took his girlfriend's cat and threws the cat against a wall in their apartment. The cat was less than a year old. He then threw the cat off the balcony of their third floor apartment. Presnail went downstairs and outside the building to pick up the cat, snapped the cat's neck and then kicked the cat repeatedly like a rubber ball.
The cat was found curled up with the garbage in a nearby dumpster, alive with a collapsed lung, bloodied body, and swollen face.
Mark spent about a year with lawyers and legalities before he was convicted.
In court, Presnail wore dark glasses was mad and defiant. He shouts bad names at cat-loving older ladies who had been in the courtroom. He blames the press.
"I was convicted because of you guys. You guys already convicted me."
"This is garbage. I don't believe it's fair. I never kicked a cat .... with any force."
Presnail said he put the cat on the balcony and it jumped off. Then, he went outside to grab it. That's all.
Is he sorry? "No, to be honest."
Mark will serve the 90 days on weekends. He supports his three year old son, he financially helps out his brother and he's gone broke. His ex-girlfriend has forgiven him.
The cat has been renamed Jasmine and has a new owner. "Jasmine is such a good cat. I can't believe it's over. I'm glad he's being punished for what he did." References- The Calgary Sun - Apr 29, 2000
