Carter Lee Byus entered a not-guilty plea on April 4, 2005 to a felony charge of animal cruelty in Cabell County Magistrate Court. Magistrate John Ray Rice scheduled a preliminary hearing for the 42-year-old city resident before Magistrate Michael Woelfel at 10:30 a.m. April 15.
City police officers charged Byus with beating a 4-month-old Rottweiler puppy to death with a 3-foot-long metal pole on April 26, 2004.
Byus� attorney, Gerald O. Henderson Jr. of the Cabell County Public Defender�s Office, told the court his client is not a flight risk, because he has attended every court session for which his attendance has been required -- maybe 15 to 20 times -- in connection with the case. The same charge was leveled against Byus twice in the past year as a misdemeanor, and was dismissed both times.
The misdemeanor charge accuses a person of cruelly mistreating, abandoning or withholding proper sustenance or medical treatment necessary to sustain normal health and fitness of any domesticated animal.
The felony charge accuses a person of intentionally torturing or maliciously killing an animal or causing or authorizing someone else to do the same.
