David S. Allen, 20, a sophmore at Syracuse University from Melville, Suffolk County, was charged with a felony count of aggravated cruelty to an animal which is intentionally trying to harm or kill an animal, and a misdemeanor charge of torturing or injuring an animal.
Piper, the beagle/Labrador retriever mix puppy suffered a badly broken hind leg and bloody paws.
Allen was angry because his 8-week old puppy was not yet housebroken. He swung it around by the leash on its neck, slammed it into a sidewalk, and dragged it across concrete.
Christopher Gross, a witness was across the street in the 300 block of Comstock Avenue, waiting to pickup his mother from work when he saw the incident. He told police he watched as suspect David Allen, "pulled the dog by a leash which was connected to the dog's neck with a collar, then swung the dog in a yo-yo fashion" repeatedly.
Gross ran into a building and dialed 911.
Paul Morgan, animal cruelty investigator the the Central New York SPCA said, "this guy was still doing it and was looking around to see if anyone was watching." Allen reportedly couldn't get the puppy to stand and carried it back into his apartment.
Allen told the police officers the dog had defecated inside the apartment and he had taken it outside to finish, but he became frustrated when the dog would not come when he instructed her to do so.
The veterinarians examined the puppy, took x-rays and determined the right rear paw had been badly fractured. The case will be heard in City Court and has been referred to the Syracuse University judicial board to determine what actions the unversity might take.
Allen mentioned he had gotten the puppy about a week ago before the incident.
The puppy's fracture is so bad that the leg will probably never heal correctly unless a vet who specializes in orthopedics does the operation. The cost for an orthopedic surgeon is about $2,000.
After the puppy has recovered the SPCA has said, "We will try to find a really good home for it. She's such a cute little thing. You hate to think about something like this happening."
