Animal control officers report that Ralph O'Neal Kellum, 46, tried to quiet a dog in his front yard by allegedly striking the dog with a cinder block.

Kellum said he only threw a rock in the direction of the retriever mix chasing his cat and eating the cat's food outside his Spring Valley Road home.

Animal cruelty investigator Richie Michael said Kellum's sister-in-law reported the incident to the Colbert County Animal Control. Michael said, "He admitted hitting the dog, but he said it was a small rock."

Michael found a cinder block outside Kellum's home which confirmed the complaint they had received. The veterinarian Joe Cobb said the dog took a blow to the head with a large object.

Kellum was charged with animal cruelty and booked in the Colbert County Jail.

After being booked at the jail, deputies found Kellum had three outstanding warrants against him for public intoxication, resisting arrest and menancing. He is being held without bail.

The dog was treated for a swollen eye and returned to his owners.

Kellum faces a fine and up to a year in jail if he is convicted.
