Defendant was a race horse trainer from Pleasanton, CA. Defendant was in town for racing at the Fresno Fair. He was charged with beating his lead pony ; the horse fell over and died while defendant was swinging a stall chain at the horse. Necropsy was incomplete due to failure to transport horse in a timely manner to the veteranarian, and fact that carcasss sat in 100 degree weather for several hours. Witnesses heard beating but did not actually observe it.
