The SPCA of Texas removed four starving horses from approximately 20 acres near Terrell Wednesday and transported them to its McKinney campus until an upcoming hearing determines the final custody of the animals.

One horse, a 4-year-old mare, had to be euthanized due to poor health. She collapsed prior to the SPCA's arrival and could barely move her head.

"She made several attempts to stand, and she had a lot of heart, but she was so malnourished that she just couldn't get off the ground," Kaufman County Sheriff's Office Investigation Sgt. Kalon Rollins reported.

The remaining three horses - a mare and two geldings - are believed to be adults at least four years old.

On a condition scoring system of one to nine, which is the standard nationwide rating system, most of the horses were estimated to rank between one and three. All had ribs and hip bones protruding and varying degrees of, if any, muscle mass.

A hearing date is scheduled for 1:30 p.m. Friday, Feb. 4 in Kaufman County.

Kaufman County officials responded to complaints about the horses' treatment Tuesday.

Investigators found the animals had no water or shelter, and only a single bale of hay that had been left for them by frustrated neighbors.

No sign of the hay remained Wednesday when the SPCA arrived, according to Ann Barnes, chief investigator for the SPCA.

The horses' owner, Luis Arturo Aprero, could face possible charges of animal cruelty.

Barnes said the SPCA could make the remaining three horses available for adoption, if the SPCA is awarded custody and the horses can be rehabilitated.
