James Kevin Binder, 21, is accused of beating a dog with a hammer and if convicted could spend up to five years in prison for animal cruelty.

When the Charleston police responded to complaints of a barking dog, a woman asked them to check on a chocolate Labrador, Casey, who lives in the apartment behind her. The woman said she heard a loud "yelp" and saw James Kevin Binder hit the dog with what appeared to be a hammer.

The police went to investigate and with flashlights on climbed the stairs to the second floor apartment Binder shares with Casey's owner. The back porch had patio furniture and feces scattered and blood was splattered near a dog cage that was pushed against the apartment wall.

When an officer looked into the cage, he saw Casey, bloody and curled in a ball. The left side of the dog's face was swollen; his left eye was "partially" missing.

Binder came to the door wearing boxer shorts. Binder said his clothes and sneakers were in the washing machine. After entering the apartment the officers saw what appeared to be a wet 8-ounce claw hammer on the kitchen table. A trail of water led to the kitchen sink.

He was not asked any questions, but freely volunteered to tell the officers what had happened. Binder said he had just returned from a party, he had been drinking and was angry his roommate's dog had defecated on the back porch. He said he swatted the dog with his hand.

Binder was arrested by the police.

Casey was taken to All Creatures Vet Clinic. Veterinarian Doug Berger worked for hours trying to save the dogs eye and tending to multiple skull fractures. After the surgery Casey was resting and in stable condition.

Binder's bond hearing will be before Magistrate Jack Guedalia and is scheduled for Jan 22, 2002 at 2:00 p.m.

The society's Animal Cruelty Team will rally there in Casey's behalf.


Case Updates

A South Carolina man convicted of viciously attacking his roommate's chocolate Lab will serve 30 days in jail for the crime. James Kevin Binder was arrested after a neighbor phoned Charleston police to report that she'd seen him attack the dog with a hammer. When officers arrived at the scene, they found the dog severely injured, with bloody wounds to the face. Binder admitted that he had been angry with the dog for defecating on the porch, but claimed he'd only "swatted" the animal with his hand. Binder also acknowledged that he was intoxicated. One of the officers on the scene reported seeing a claw hammer on the kitchen table.

Police took the dog to a local veterinarian, who treated the animal for multiple skull fractures and grievous injury to the left eye. The dog survived. Binder was charged with "ill treatment of an animal."
