Dog kicked to death

Robbie Wittchow, 27 entered a no contest plea to kicking his dog, a 2 year old blue heeler, causing death, because the dog defacated on the floor.

He was sentenced to 13 months in prison despite the state's request that he receive no prison time. Previous reports indicate Wittchow frequently abused his dog (boda) by making it eat it's own feces, kicked, punched and choked the dog. Wittchow is currently serving an 8th month sentence for a fifth drunken driving conviction.

Wittchow, of Fond du Lac entered a no contest to the mistreatment of animal causing death charge in April, and asked Fond du Lac County Circuit Court Judge Steven Weinke to release him from jail so he could volunteer at a local Humane Society and prove himself. Weinke denied the request.

Wittchow kicked his 2-year-old blue heeler, Boda, in the chest after the dog defecated on the floor in January 2001.

Reports filed with the police department before the dog's death allege Wittchow frequently abused his dog, made Boda eat his own feces, and kicked, punched, and choked Boda. 

Assistant District Attorney Scott Mortier said the state did not ask for jail time because Wittchow had no past crimes, except traffic.

According to court records, Weinke received several letters from community members asking him to hand down a stiff sentence for what they felt was a heinous crime.

The abuse was reported to police after Wittchow took the dog to Country Hills Animal Clinic in Eden for cremation and admitted to a veterinarian that he kicked the dog.

Wittchow is to remain on 35 months of extended supervision, provide a DNA sample to the court and pay a $250 donation to the Humane Society.

Weinke also ordered Friday that Wittchow obtain anger management counseling, possess no firearms, not gain employment where animals are involved, and not own any pets.
