Joe E. Hunter, 46, was convicted by a jury of animal cruelty for beating a 4-month old puppy in a flower bed at the apartment complex where he lived on Nov 4, 1999. Residents of the Mercury Court Apartments, 411 Murfreesboro Pike, said Hunter struck the dog repeatedly with a stick or a rod.

He has been placed in jail for nine months.

Hunter's conviction on misdemeanor charge of animal cruelty is likely to result in revocation of the parole he was granted in 1996 on a series of drug sale charges, his parole officer said.

Criminal Court Judge Seth Normal cited Hunter's criminal history which includes convictions for manslaughter and armed robbery. He sentenced Hunter to 11 months and 29 days - the maximum possible for a misdemeanor and ordered him to serve 75% of the sentence.

James Foster, Hunter's parole officer, said he had requested a parole violation warrant on Hunter which is likely to result in him serving additional time in prison on the 27-year sentence he received on three drug sale charges in 1988. Hunter spent eight years in prison on the drug charges before he was released on parole in 1996.

Foster, said "He broke the rules of his parole, which says to obey the law."

One of the residents said Hunter responded with an obscenity when she asked him to stop hitting the dog.

Hunter testified the dog "got in my way" and he felt he was justified in hitting the dog.

Metro Animal Services officers took possession of the dog and cared for it for over a year after its owner failed to claim it. The dog, called Toby, has been adopted by a family.
