A 20-year-old Pittsfield man was charged with animal cruelty Jan 31 after he allegedly kicked a small dog while arguing with a relative, police said.
Jason M. Dowling of Oak Street also pleaded not guilty to that and to two counts of disturbing the peace yesterday when he was arraigned in Central Berkshire District Court.
Judge Paul M. Vrabel released him on personal recognizance, pending a pretrial hearing March 1.
According to a police report on file in District Court, Dowling allegedly kicked his aunt's dog, a miniature pinscher, after he had gone to her house, located across the street from his home, to ask for a ride. Dowling was intoxicated, police said.
When his aunt told him to wait five minutes because she wanted to finish dinner, Dowling "flipped out," according to police. He became verbally abusive, kicked the dog, slammed the door as he left his aunt's house, and then kicked a parked car.
After Dowling kicked the dog, which had been barking at him, the animal went "airborne" for a few feet before it landed and let out a "yelp," police said.
Officers, who arrived on the scene at 8:11 p.m., found Dowling on Adam Street "very intoxicated and unsteady on his feet."
Based on statements given by his aunt, the officers took Dowling into custody.
The maximum penalty for animal cruelty is five years in state prison and a $2,500 fine.
