Authorities found five puppies and 17 severely neglected dogs at Charles Ellerson's Palmetto home on Jan. 29, according to Herald archives. The animals were allegedly kept inside 3-by-3-foot crates and had gone without food and water for several days.
Assistant State Attorney Julie Binkley said she intends on pursuing the case even if the judge dismisses it as a felony case.
"At this point, I wait for a ruling," she said. "I'm anxious to see what the ruling is, and if he does dismiss it, I'll be anxious to see why."
A date for the judge's ruling hasn't been specified.
Case UpdatesCharles Ellerson pleaded no contest to 10 counts of the charge last week. The state attorney's office decided not to prosecute Ellerson on the other 12 counts of animal cruelty.
Because Ellerson waived his right to trial on the charges by pleading no contest, Circuit Judge Peter A. Dubensky sentenced Ellerson to three years probation and 150 hours of community service at a rate of 10 hours per month, court records show.

Circuit Judge Peter Dubensky has denied a defense attorney's request to drop 22 felony counts of animal cruelty against a 62-year-old Palmetto man.
Dubensky issued a written ruling which denied a motion requesting dismissal of the felony charges against Charles Ellerson. His ruling was posted Wednesday, a court employee said.

At a hearing Friday morning, Ellerson's attorney James Golden asked the judge to dismiss the 22 felony counts, lowering them to misdemeanor charges.
