Robert Boyle, 34, and his wife, Diana, 26, a Lake Road couple will appear in Akron Municipal Court to face charges of cruelty to animals.

They had stated their dog appears starved because it is anorexic.

A neighbor had phoned police to say the Boyles' dog was tied to a tree without food or water for three weeks.

A report by Detective Denise Johnstonbaugh says that when she arrived, "the dog could barely sit upright. The dog was dry heaving and was skin and bones."

"The dog was chained to a tree and had approximately two feet of chain available to move. There was no food or water present."

The dog, a one to two year old boxer female, is doing well at the Humane Society of Greater Akron shelter on Quick Road where it was taken for its safety. Reports say the dog is "eating just like any other dog."

The Humane Society Director Simes said the dog is "obviously in a starvation condition at this point. She weights 40 pounds and she should weigh 70."

The dog has not been cared for in an appropriate manner as required by the Ohio law.
