Gilbert D. Wozney is charged with three misdemeanor counts of cruelty to animals and Sidney Dale Shipman is charged as an accessory in three counts.

According to an affidavit filed by Deputy County Attorney Janci Van Wagoner, the two roommates were left to care for the three dachshunds when a third roommate, Jacqueline Lewis, was hospitalized on June 16.

The men are alleged to have taken the dogs to a gravel pit where Wozney hit each one on the head with a hammer, according to the affidavit.

One dog escaped and was found on June 18. The other dogs were reported missing on June 27.

Wozney initially said the dogs had escaped on June 18 but later changed his story. He came home from work and found the dogs barking in Lewis' room.

"Sidney Shipman told Gilbert Wozney that the dogs had to go," the affidavit reads. "Gilbert Wozney advised that he disagreed with Sidney Shipman. Gilbert Wozney felt that it was not their place to do anything with the dogs."

According to the affidavit, Wozney told police that later that evening, "Shipman put the dogs on leashes and put them in the back seat of Sidney Shipman's vehicle."

Wozney got a hammer, and the men took the dogs to the gravel pit, according to the affidavit.

The affidavit also said, Wozney hit the male dog on his head, then struck the other dog, a female on the head two or three times.

Shipman initially denied being involved, then said he put leashes on the dogs and put them in the back seat of the car. He said he knew Wozney would kill the dogs.
