Carl Wallace, 45, convicted of cruelty to animals a misdemeanor, for the Feb 28, 1995 incident when he struck a dog with the snowplow mounted to his El Camino, then got out and chased the injured animal with a shotgun. Neighbors interceded and called the police.

A judge ordered Wallace to spend 30 days in jail and pay a $1,000 fine, a harsh sentence aimed at punishing him for his lack of remorse for what the judge described as avengeful act.

The dog, a dark brown chow chow, suffered a broken back but survived.

Wallace, bitten on the hand and leg, was thrust into the criminal justice system.

Wallace's attorney, Peter Rodway, said his client did not deserve a jail sentence. The man is not the "monster" the media made him out to be, he said.

Rodway is appealing Wallace's conviction trial, which will delay the start of his jail sentence.
