A 39-year-old homeless man was arrested Dec. 20 carrying a box containing the body of a Chihuahua. Authorities say James Dixon had broken into a yard south of Las Cruces and beheaded the family dog. He is charged with extreme cruelty to animals and criminal trespass.

James M. Dixon, a 39 year old homeless man accused of killing and beheading a Chihuahua dog had his arraignment postponed Tuesday after he argued about the case and refused to enter a plea. Court documents show an Oklahoma address for James Dixon. When Dona Ana County Sheriff's deputies stopped him carrying the dog in a box after gutting and beheading it with a knife, he the told deputies he was hungry.

He was set for arraignment on charges of cruelty to animals and criminal trespass. He told judge the complaint against him should come from the dog's owners not the state of New Mexico. Because Dixon didn't enter a plea of guilty or innocence, the court will try to arraign him again on Monday.

Dixon remains in the Dona Ana County Detention Center with bond set at $25,000.
