Bellaire police have charged a woman for obnoxious odors - they say the odors were from all the animals. Back in July, Bellaire police cited 79-year-old Mary Kindle for obnoxious odors coming from her house. "When she would open up her windows the odor would saturate the neighborhood. And it was feces, animal feces dogs and cats both, " says neighbor LouAnn Bennett.

Chief Wallace says Kindle went before the Bellaire Mayor's Court - but never took care of the stench. Wallace states that the case was transferred to Eastern Division Court - and Kindle failed to appear for trial. Wallace says the judge ordered the Humane Society to remove the animals from the woman's house.

According to a report from the Bellaire Police Department, at 1:43 p.m. on Sept. 10 a Belmont County animal control officer went to the residence pursuant to the court order to remove all of the animals. The animal control officer reported to Bellaire police that he was obstructed by Kindle, and Bellaire officers responded to the scene. Kindle had to be physically removed by a Bellaire officer after she reportedly tried to bite him and then scratched his arm.

"Yesterday we were able to remove over 30 animals from the house. We suspect there may have been some others who'd gotten away before we arrived," says Wallace. Police say 23 dogs...6 puppies...And 3 cats to be exact.

Chief Wallace says the smell was so foul - officers were gagging as they entered the house. Police say the floors were covered with feces from the animals...And the animals were covered with flies and maggots.

"I told the judge I didn't want to see her go to jail. I didn't want her fined. We just want to be able to breathe, and I don't think that's too much to ask," says Bennett.

The charges were filed on Sept 22, 2004 by Humane Officer Lisa Williams. Shelter Supervisor Verna Painter tells explains that the charges are for animal cruelty and for the assault of Williams when she came to Kindle's house after a court order to remove the animals.

Her next court date is set for September 30th.

She was ordered never to own or harbor a pet again, but now Rosalie Kindle might be up to her old habits. Belmont County Humane Officer, Lisa Williams, got a tip that the woman had a severely neglected animal in her apartment. The officer was able to get a search warrant and enter. What she found was shocking and may lead to criminal charges. Williams tells Seven News she found one cat paralyzed and with open wounds and maggots. They took it to Animal Urgent Care but it had to be euthanized. The report is being forwarded to the prosecutor's office and charges may be filed. Rosalie Kindle is reportedly in her late 70's to early 80's.
