A Town of Evans man is facing charges for killing his neighbor's dog with an ax -  the same man who shot another neighbor's dog in the face two months ago.

Patricia Bangel is devastated over the loss of her dog Sis, the Welsh Corgi mix and another dog got out of their pen this morning, but Sis never came home. According to police, neighbor Robert Rydzewski killed the dog with an ax.

Rydzewski reportedly told Police the dog was going after his rabbits and him when he killed her. This neighbor who did not want to be identified said he saw Rydzewski right after the dog was killed.

And this is not the first time Rydzewski has been accused of harming a neigbors pet. In march he was charged with torturing and injuring an animal after Police say he shot this dog Mollie in the face, claiming she too went after his rabbits and him.

Rydzewski is facing a new charge of torturing and killing a domestic animal, and those who live in his neighborhood say they'll be keeping their pets close to home.


Case Updates

Judge Timothy Hooper ordered him to spend 90 days in jail, one year on probation, take anger management courses and pay a 200 dollar fine.

The judge also granted both dog owners permanent orders of protection from Robert Rydzewski.

Robert Rydzewski of the Town of Evans pleaded guilty late Monday evening to two counts of "torturing or injuring" animals.

He admitted firing two shots into the face of a dog on March 28,2004 and killing a dog with an ax on May 25, 2004.

Rydzewski, 29, accepted the surprise plea offer before Town Justice Timothy J. Cooper after meeting with the prosecutor, Assistant District Attorney Amy Benedict. The plea deal includes dismissal of all other charges, including reckless endangerment for allegedly pointing a rifle toward someone during the shooting incident.

Cooper set Oct. 25, 2004 for sentencing. The two misdemeanor counts under the Agriculture & Markets Law carry up to a year in prison.
