Officer T. J. Stevens responded to a report of a dog inside a parked vehicle in the 3100 block of Welcome Road. The vehicle was parked in front of a townhouse. The windows were rolled down to provide a 2 inch opening. No one responded to the door in answer to the officer's knock. The officer removed the dog, a rottweiler. The inside temperature of the vehicle was 102 degrees. The dog's body temperature was 106.8 degrees. The officer cooled the animal with water and gave water to drink.

The owner came outside from the townhouse to speak with the officer. The owner told Officer Stevens that she put the dog in the vehicle because it was sometimes aggressive. The officer charged the owner, Barbara J. Lynk, BF 40 years old, with cruelty to animals, a class 1 misdemeanor. The owner surrendered the dog to the City.

The case was heard in General District Court Criminal Division on August 3, 2004. Barbara Lynk was convicted of cruelty to animals. She was fined $100 plus costs of court, $50 of which was suspended.
