Daniel J. Joyner was charged with two counts of engaging in sexual conduct with an animal, class four felonies, and a third count of criminal damage to property by injuring the female pitbull/boxer mixed breed dog. Joyner alledgedly placed a bottle in the anus of the dog for the purpose of arousal, then placed his penis in the anus of the doc for the purpose of sexual arousal.

Joyner eluded police for several days, then showed up for bond call over the weekend and was charged with the felonies.

Bail is set for $50,000. If convicted, Joyner faces a sentence from one to three years and a fine of up to $25,000 on each charge, or probation. The court date is currently set for July 29, 2004.


Case Updates

Daniel Joyner was released Monday to an in-treatment drug abuse center.

A Kane County judge released Joyner, 27, pending a January sentencing on four charges, including using a liquor bottle to assault a pitbull owned by a Geneva man.

Joyner has been in the Kane County jail since June 29 when he turned himself in to police following the pitbull accusations. During a two-day trial this month, Joyner was found not guilty of sexually assaulting the animal, but guilty of criminal damage to property.

Because the crime involved an animal, he could face one to three years in prison.

But his attorney, Tim Martin of Naperville, is confident the judge will take into consideration how long Joyner has been in jail and give him two years of probation for the property damage, as well as charges of retail theft, heroin possession and DUI that Joyner also faces.

Three of the charges had been in Kane County's drug court, an intensive two-year program of counseling and random drug testing. Their outcome had hinged on Joyner's completion of the program.

He opted out of the drug court Monday, so sentences will be meted out on those cases as well as the property damage.

His progress in a 30- to 120-days in-patient substance abuse treatment center likely will factor into his sentencing on the four combined charges. But even if he shows a dramatic turnaround in his drug habits, prosecutors said he should face repercussions for his past actions.

Prosecutor Debra Bree scoffed at the idea of probation for a man who has already violated probation on a 2001 retail theft charge and a DUI. Following the probation violations, Joyner was resentenced for those charges to the county's drug court. While in the drug court, he was arrested in 2003 for possession of a controlled substance.

At the time of his arrest June 29 for the pitbull abuse, Joyner also was on probation for a possession of cannabis charge out of DuPage County.

"He's on his fourth felony," Bree said. "We want jail time."
