Rabbit thrown from balcony
Chesapeake, VA (US)

Incident Date: Thursday, May 13, 2004
County: Chesapeake City

Disposition: Convicted

Defendant/Suspect: Gary Druyos

On May 16, 2004, ACO Hazlitt responded to the 200 block of Mill Creek Parkway in reference to a report of a subject throwing a pet rabbit from a third floor balcony.  Witnesses stated Gary Druyos, a white male 20 years old, walked to the edge of the balcony stretched out his arms and dropped the rabbit over the railing.  When officers arrived, they did not find the rabbit.  Later the subject retrieved the rabbit's body from under his bed in the apartment.  He denied that he threw the animal, claiming it had jumped.  Officers took custody of the body and later transported it to a veterinarian for a documented determination of cause of death.  Mr. Dryuos was charged with cruelty to animals.

According to the necropsy, the rabbit died from multiple fractures, a lacerated liver and internal hemorrage.  Druyos was convicted of cruelty to animals in General District Court Criminal Division on 5/13/04.  He was sentenced to 12 months in jail, with 9 months suspended.  In addition he received probation for 2 years.  Mr. Druyos has appealed.
