A San Antonio family must give up its pets after a case of alleged animal abuse is caught on videotape by a neighbor.

In the tape, the dog's owner, Gabriel Garza is seen swinging at the dog.

Garza's two dogs are in custody of Animal Control until workers can find them a place to live. The pets owners are upset about this entire situation.

The judge took the dogs away from garza after his neighbor, said she caught him on videotape beating one of the dogs named, Sammy.

Misty Willis, Garza's fianc�, and says Garza would only hit his pets to discipline them.

The judge ruled there was enough evidence to remove the pets from Garza's home.

Garza has to pay a fine for the dogs temporary housing of 112 dollars. Willis stated she and Garza will appeal this decision, and continue to fight to get their dogs back.
