Sixteen horses were reportedly found living in deplorable conditions. They were severely undernourished. The barn that was provided for them was so dilapidated that it did not offer adequate shelter form the elements.
Hammaker was convicted of five counts of cruelty to animals for failing to provide adequate food and water to his horses, and one count of cruelty for failure to provide shelter. He was sentenced to a sixty-day term of imprisonment for each count, but the court suspended all of the sentences and placed him on two years of probation. He was also fined $1,500.00.
