On May 29, 1995, an appartment complex manager reportedly responded to complaints of neighbors of a dog barking for several days in the appartment of Charles Thornton.  After making several attempts to contact Thornton, the manager entered the appartment using the complex's key.  The manager reported that she found a brown-colored dog in a small cage in a secondary bedroom.  The cage was so small that the dog could not stand inside the cag.  The bottom of the cage was covered in urine and feces.  There was no sign of food or water in the cage.  The dog was very thin and had blood on its paws.  The dog was shaking and continuously made a whimpering and yelping sound.

The police were called and the dog was removed from the premises.

Thornton was convicted of cruelty to an animall.  He was sentenced to ten days imprisonment, two years of probation, and two hundred hours of community service, and $3,571.83 in restitution.

Thornton filed an appeal.  The Apellate Court of Illinois overruled the order of restituion to the County Animal Department which provided shelter and veterinary care for the dog because neither the Department nor the dog could be considered a "victim" under the provision for restitutionary penalties for the cost of impounding the dog.
