A hotheaded Queens bodybuilder killed his dog by tossing it out of a third-floor window - then played dumb, telling cops he was asleep the whole time.

Milan Rysa, 30, hurled Brooklyn, a Chinese Shar-Pei weighing about 50 pounds, out of his apartment on 30-59 Steinway St. in Astoria as he played thumping dance music about 8:30 p.m Monday, police and witnesses said.

"I saw it coming out the window," a shocked witness said, declining to give his name. "I heard the yelp when it hit the ground. I heard the thud. It just missed a woman."

Witnesses said Rysa looked out the window, saw a crowd gathering near Brooklyn's broken body, then shut off the music and the apartment's lights.

Cops, not sure what they would encounter inside the apartment, armed themselves with a battering ram and bulletproof shields, witnesses said.

But Rysa eventually opened the door and claimed he was just catching some shut-eye, a witness said. He was booked for aggravated animal cruelty and reckless endangerment, and taken to Elmhurst Hospital Center for a psychiatric evaluation.

His Facebook page abounds with shirtless, beefcake photos of himself. But it also includes an album called "My Lil Bad Boy" that shows Brooklyn as an adorable puppy.

Neighbors had no idea what prompted the heinous crime, but several said they had previously seen Rysa abuse the animal, keeping him in the public hallway outside his apartment, fenced in by a toddler gate.

Rysa also let Brooklyn relieve itself on the roof. He would fling the dog's feces onto nearby rooftops, then leave the dog unattended for hours, the hot rooftop burning his paws, one neighbor said.

"The poor thing wanted to play all the time," the neighbor said.

fter a psychiatric exam by a court-appointed physician, the Astoria bodybuilder who allegedly threw his dog out a window to its death, Milan Rysa, was deemed fit to stand trial on Oct. 7, according to the Queens District Attorney's Office. He is scheduled to appear in court again on Oct. 24 for a pre-trial conference.

Rysa made bail after his Sept. 12 arrest, but remained imprisoned, as is the procedure when such an evaluation is requested, according to Kevin Ryan, a spokesman for DA's office.

The defendant is being held at the Vernon C. Bain Center, a correctional facility in the Bronx, because he has an outstanding warrant, according to Sean Jones, a spokesman for the DOC, through he said he did not have further information on the reason for the warrant.

Rysa, 30, allegedly tossed his 50-pound shar-pei, Brooklyn, out of his apartment window on Steinway Street at around 8:30 p.m. on the night of the 12th. He is charged with animal cruelty for allegedly killing the animal and second-degree reckless endangerment because the canine nearly struck two women before hitting the pavement. He could face two years in prison if convicted.

Councilmember Peter F. Vallone Jr. last week added his voice to those of Astoria residents who are seeking justice for Brooklyn, the 50-pound Shar-Pei, whose owner allegedly tossed the pup three stories to his death on September 12.

Vallone, a self-described animal lover, last week said his office has received calls and messages from at least 100 constituents who voiced outrage over the incident.

Vallone said he plans to make sure that Milan Rysa, the hulking bodybuilder charged in Brooklyn's death, receives appropriate punishment for the crime, including jail time.

Vallone said he is also investigating to determine why the ASPCA was not immediately notified of the incident - and why an autopsy was not performed on the pup.

The Astoria lawmaker, who dubbed Rysa a punk and a creep, said he loves dogs. In fact, his children have a Bichon Frise named Gus Gus, after the mouse in the Disney movie, Cinderella, Vallone said.

A crowd of about 30 people gathered outside Rysa's third-floor window on Steinway Street on September 20 at a candlelight vigil for Brooklyn. The crowd thickened as passersby joined the vigil shouting, "Puppy killer, leave town," and "There's no excuse for animal abuse!" while holding photos of the dog.

Rysa, 38, was charged with animal cruelty and second-degree reckless endangerment, Queens District Attorney Richard Brown said. He faces up to one year in jail on the animal cruelty charge and one year for reckless endangerment, if convicted.

A spokesperson for the ASPCA told the Gazette that animal abusers usually suffer from serious psychological problems that require treatment. Recent research has provided a link between animal abuse and other violent crimes, such as weapons violations, domestic abuse and sexual assault, the spokesperson said.

The number of arrests made by the ASPCA Humane Law Enforcement Unit for animal abuse in Queens has doubled in the last year. The unit arrested six animal abusers in 2010, compared with 12 abusers so far this year.

At his arraignment at Queens Criminal Court, Rysa was ordered to Elmhurst Hospital Center for a psychiatric evaluation and was taken to Riker's Island to await disposition of the case.
Rysa's attorney has requested a second evaluation to determine if his client is fit to stand trial, a spokesperson for the Queens District Attorney's office said.

Milan Rysa, the Astoria bodybuilder who allegedly threw his dog out a window to its death, will be spending a little more time in prison as he awaits his next court date.

Rysa was in Queens Criminal Court on Friday, but the case was adjourned until Oct. 7, because he had not yet received a psychiatric evaluation as requested by his attorney, according to the Queens District Attorney's Office.

After he was initially arrested on Sept. 12, Rysa posted the $3,000 bail and was released, but after his first court date on Sept. 22 he was sent to Rikers Island where he continues to be held, as is the procedure whenever someone requests a psychiatric exam, according Kevin Ryan, a spokesman for the Queens DA.
