Alleged: Nidra F. Billard

Nidra F. Billard, 30, was charged with felony animal cruelty.

The Harris County District Attorney's Office said Billard threw the pit bull puppy from a stairwell balcony in the 9400 block of Clearwood on the city's southside.

"Specifically, she is being charged with torture. The defendant threw the puppy after getting in a fight with her boyfriend," Assistant District Attorney Belinda Smith said.

Police told Local 2 the puppy was owned by Smith's boyfriend but is now at the city's animal shelter, BARC.

"He is blind now. We want to find the right foster family for him while this gets sorted out. Maybe that family will end up adopting him," BARC's general manager Dave Atencio said.

Witnesses said on June 1, Billard threw the dog shot-put style off the apartment complex balcony to the ground 50 feet below.

"It was tragic man, tragic. It couldn't get up. It was just laying there on its side." neighbor Kayon Manuel said.

The dog's prognosis is good if it can find a good home. The dog will most likely not be returned to Billard's boyfriend, according to Atencio.

If convicted, Billard could spend up to two years in jail and pay a $10,000 fine.

Billard is free on $5,000 bond.
