Chihuahua kicked into brick wall, leg broken

A man who kicked his neighbor's pet dog "so hard" that it now requires surgery is facing aggravated animal cruelty charges.

Mark Byrne, Amber Meadows Road, age unknown, has also been charged with assault following the May 27 incident. An affidavit says he intentionally kicked the 4-year-old black Chihuahua, throwing the dog against a brick wall. The dog is now unable to walk on its injured hind leg, according to an affidavit on file.

A 16-year-old neighbor, the affidavit says, who was trying to get the animal, had pleaded with him not to hurt her dog, but the subject "got in her face and screamed" at her, saying he would kill it if it didn't get off his property. "The anger and look in Mark Byrne's eyes caused the 16-year-old to fear imminent bodily injury," the statement says.

According to second affidavit on file, the dog was taken to Copeland Veterinary Hospital in Cookeville and surgery will be required to repair the leg. The initial vet bill is $107 and the surgery is estimated to cost $1,700.

Byrne has an initial July 11 court date.
