Dog kicked during break-in
Bourne, MA (US)

Incident Date: Saturday, Mar 12, 2011
County: Barnstable

Charges: Misdemeanor, Felony Non-CTA
Disposition: Alleged

Alleged: Joshua D. Lach

A Sagamore Beach man couldn't avoid arrest despite jumping from a second-story window to escape the police, according to court records.

Joshua Lach, 28, of 29 Williston Road is being held at the Barnstable County Correctional Facility on $10,000 bail after an incident last weekend in which he allegedly attacked a woman and destroyed some of her belongings, court records state.

On Saturday just after 1 a.m., the Bourne police responded to a Freight House Road home after receiving a call in which a woman whispered the home's address then hung up, according to records.

The woman at the home told officers that Lach came to the home, pushed through the front door and began smashing several items the woman owned -- including a laptop, an iPhone and two radios -- with a baseball bat. When she told him to leave, Lach allegedly punched her in the face and temple, slammed her into the floor, bit her hand, and "jabbed her" with the bat, records state.

He also kicked a dog in the side "in an attempt to shut it up," records state.

When the police arrived after the woman called 911, Lach allegedly jumped out of a second-story bathroom window to escape, taking the woman's car keys with him, according to court documents.

The woman received an emergency restraining order against Lach that night, and the Bourne police arrested him at his home at about 6 p.m. Monday, police records state.

He was arraigned Wednesday in Falmouth District Court on charges including assault and battery with a dangerous weapon (baseball bat), home invasion, malicious destruction of property, intimidating a witness and cruelty to an animal.

Bail was set high, according to court documents, because Lach has "a similar open case with the same female victim" currently pending.

He is scheduled for an April 13 pretrial hearing.
