A Charleston man has been charged with felony animal cruelty after he allegedly drove onto his neighbor's property and intentionally hit her dog, which later was euthanized.
On Monday, Samantha Peyton let her dachshund, Oscar, out of her home on 12th Street in Charleston to relieve himself when her neighbor, Richard Dale Johnson, 58, drove down the street in his 2009 Chevrolet Silverado, and intentionally struck her dog on her property, according to a criminal complaint filed in Kanawha County Magistrate Court.
Peyton said her dog had not been out in the street and that she allegedly watched Johnson pull onto her property and hit Oscar. She told officers she heard her dog squeal and found him "lying lifeless in her driveway," according to the complaint.
Police say Johnson kept driving and did not stop until he pulled over at a different neighbor's residence.
Johnson told police he did not run over his neighbor's dog, but he did admit to saying in the past that "he would kill their dogs," according to the complaint.
Oscar was taken to Kanawha Boulevard Animal Hospital, where a doctor told Peyton he had suffered multiple abrasions to his abdominal area, a diaphragm hernia with hemorrhaging, and damage to his chest cavity, according to the complaint.
The dog was euthanized due to his poor physical condition.
A warrant was issued for Johnson and he was arrested on felony animal cruelty charges. Magistrate Joe Shelton arraigned him and set his bond at $5,000.
He will be in the South Central Regional Jail until bond is met.
