Shriver was arraigned in magistrate court Monday afternoon.

The sheriff's department says it received several complaints about a foul stench coming from his property just outside of Barrackville.

After an investigation, it found the bodies of 21 horses, steers and donkeys, officials said.

Several other animals were found alive but malnourished and unhealthy on the property, the Sheriff's Department said.

The magistrate set Shriver's bond at $1,000 per charge.

The sheriff's department says more charges could be pending.

Case Updates

An animal cruelty case in Marion County is scheduled for a jury trial in November. Howard Paul Shriver, 30, faces 41 counts of animal cruelty.

According to court documents, numerous dead horses and neglected animals were found on Shriver's property in April.

Last week, Shriver's defense asked the judge to suppress evidence specifically, crime scene photos, if the case went to trial.

Magistrate Melissa Linger denied that motion on Monday.

No new motions were filed by the end of Monday. Shriver's trial is scheduled for Nov. 16.

A Marion County man accused of having dead and malnourished animals on his property is back in court.

Howard Shriver, 31 is charged with 41 counts of animal cruelty after Marion County Sheriff's Deputies found dead horses, horses tied together and a dead bull hanging from a tree.

In January, Deptuies from the Marion County Sheriff's Department were sent to Shriver's home after someone informed police that Shriver was dragging a dead horse beside the road with his pickup truck. After arriving on scene, police observed a horse laying on the ground beside the road and it's head was tied to the two hitch of a pick-up. The horse was still alive and was making several attempts to get up and looked in very bad physical shape.

Also while on scene, police heard a thump come from the inside of a horse trailer, and observed a donkey that was also trying to get up and could not, and also appeared in bad physical shape.

Today, Shriver's attorney requested that some of the evidence being presented against him be suppressed. If it isn't, then his attorney requested that Shriver go before a bench trial.

A magistrate is expected to release a ruling on the request for suppression of evidence sometime on Friday.

The Marion County sheriff's department has re-arrested a man on more charges of animal cruelty.

Howard Shriver was arrested last Monday, April 5, after deputies found 21 dead animals on his property.

The sheriff's department now has arrested him again, this time for failing to bury the animals.

It was Shriver's obligation to bury the carcasses within 24 hours because they pose it a public health menace, the criminal complaint said.

He faces 24 more counts of animal cruelty.

Bail is set at $300 per charge.
