A Randolph County man is accused of leaving his puppy chained outside for extended periods without access to food or water.

Shean A. Bosworth, 27, was charged this week with cruelty to an animal, a Class A misdemeanor carrying a maximum one-year jail term.

According to a police report, an officer described the puppy as "extremely thin and malnourished" when police were called to Bosworth's neighbor's home, in the 600 block of South Main Street, on Aug. 13.

"I could see all the dogs' ribs and its hip bones protruding and determined the dog to be emaciated," the officer wrote.

Neighbors told police the dog appeared to be left unattended in Bosworth's back yard for days at a time, including some of the hottest stretches of the summer.

The woman who called police said she at times slipped a bowl of food to the female puppy under a fence, saying she was "concerned about how poorly the animal looked."

Melanie Robinson, Winchester's animal control officer, told police she had tried to contact the puppy's owner without success for two weeks, and had also left food and water for the canine.

An initial hearing on the cruelty charge is set for Nov. 24 in Randolph Superior Court.

Authorities might also have some questions for Bosworth about his whereabouts on Aug. 14, the day Robinson reported someone had broken into the city animal shelter and taken the animal.

On Aug. 15, the same officer reported he returned to Bosworth's home, at 610 S. Main St., and "observed the dog in the house looking out the front door."

Another man at the house reported the dog belonged to Bosworth, and said the animal had been in the back yard, with a new collar and chain, when he arrived at the home the previous day.

Court documents filed this week list Bosworth as living in the 2200 block of South Randolph County Road 625-W.

He was convicted of driving while intoxicated in 2007, drawing a suspended sentence.


Case Updates

Authorities have dismissed a cruelty-to-an-animal charge pending against a Randolph County man after determining he was in North Dakota at the time the crime occurred.

Shean A. Bosworth, 27, had been charged with the Class A misdemeanor in October after a neighbor reported a puppy had been left chained outside Bosworth's Winchester home for extended periods without access to food or water.

Randolph County Prosecutor David Daily filed a motion to drop the charge last week, saying there was reasonable doubt that Bosworth ever owned the dog in question.

Daly said he was now contemplating filing a charge of false informing against Garrett Shane Anderson, who told police in August that the neglected dog belonged to Bosworth.

Witnesses had reported the female puppy, described by officers as "extremely thin and malnourished," had been left unattended in the back yard of a South Main Street home during some of the hottest stretches of the summer.

The puppy was taken to the city animal shelter on Aug. 14. The following day, someone broke into the shelter and took the dog.

On Aug. 16, a police officer found the dog back in that South Main Street home, along with Anderson, who reported the canine belonged to Bosworth.

In a prepared statement, Daly said the information Anderson gave to investigators "was not only factually incorrect but was provided with the intent to mislead or misdirect the police."

The prosecutor said a charge of cruelty to an animal filed against Anderson in May 2009 is still pending.

Anderson is also set to stand trial Feb. 2 in Randolph Superior Court on a residential entry charge filed last March.

According to court records, Anderson since 2006 has been convicted of driving while intoxicated, public intoxication, criminal mischief, leaving the scene of an accident and furnishing alcohol to a minor.
