An 18-year-old Hastings man has pleaded no contest to three counts of intentional cruelty to animals.
Adams County authorities say Justin Jones and a 15-year-old accomplice killed a calf, cow and horse in September 2009.
The Hastings Tribune says that in court on Wednesday [Sept 8, 2010], Jones also pleaded no contest to operating a vehicle to avoid arrest.
His sentencing was set for Oct. 18.
In return for Jones' pleas, prosecutors dropped seven firearms counts, five counts of criminal mischief, and charges of assault and reckless driving.
The boy is fighting to have his case tried in juvenile court.
Case UpdatesThe case of a 15-year-old Hastings boy accused of illegally killing livestock will now be heard in the juvenile court, a judge ruled Thursday.
Adams County District Judge Stephen Illingworth on Thursday sustained a motion to transfer the case to juvenile court.
The boy's attorney, Gene "Skip" Foote, argued for the transfer during a hearing on Aug. 31. Given the boy's age, Foote said it would be the appropriate venue for the case.
"I feel it belongs in juvenile court where they can keep an eye on him for his minority," Foote said.
But Adams County Attorney Donna Fegler Daiss asked to keep the case in the district court. She said age is only one consideration for whether a case should be held in juvenile court.
Daiss said the violence involved in the crime seemed to be perpetrated for pleasure, indicating anti-social behavior. | Source: Hastings Tribune - Sept 10, 2010 Update posted on Sep 13, 2010 - 12:53AM |
