A 29-year-old Garber man was arraigned Thursday on a charge of animal cruelty for allegedly beating a kitten.
Because of a prior felony conviction, Matthew Lynn Davis faces a possible sentence of up to 10 years in prison if convicted of the felony charge. He was convicted in December 2008 of failure to register as a sex offender.
According to an affidavit filed in the case, Garber police were contacted July 7 by Davis, who said he had clubbed a kitten in the head with a 2- by 4- foot board and needed animal control to contact him.
Garber Police Chief Jean-nie Tappan contacted animal control officer Jim Whitehead at Davis’ residence. Upon arriving they found a dark gray kitten with a striped collar on Davis’ porch and his children standing around it, according to the affidavit.
Davis said he was sorry for the cat and Whitehead took the cat to his truck to put the animal down.
After Tappan left, Davis’ soon-to-be ex-wife contacted police and told her, “I hope you don’t think this was accidental. He kills animals all the time,” according to the affidavit. She told Tappan when she and Davis lived with her grandmother the dog died, and Davis said someone had broken in and killed the dog, according to the affidavit. Police were called and there was no forced entry found.
The woman also said she once was bathing a dog and Davis said he would do it. She left the room and found the dog limp when she came back, the affidavit states.
She said they have had several animals and they all ended up dead by Davis’ hands, the affidavit states.
Davis also was arraigned on a misdemeanor charge of driving with a suspended license. His bond is $7,500 on the felony. He posted a $500 bond on the misdemeanor.
Davis was ordered to return to court Aug. 19 for a bond appearance. References |
