Dog repeatedly kicked by 12 year old boy
Nashua, NH (US)

Incident Date: Wednesday, Nov 25, 2009
County: Hillsborough

Charges: Felony CTA, Felony Non-CTA
Disposition: Alleged

Alleged: 12 year old male name undisclosed

A 12-year-old boy, irked that an old Doberman Pinscher shied away from a fight with a pit bull, repeatedly kicked the dog in the abdomen and back, injuring its spine, police said.

The boy, who is also accused of knocking down a 10-year-old girl to try to steal money she earned shoveling snow, was ordered held at the Youth Detention Services Unit in Manchester.

Lt. Jeffrey Bukunt said that generally police do not arrest juveniles under the age of 13. When they do, he said, it is because of the nature of the offense and the juvenile's prior record.

"In this case, the juvenile does have a significant record involving other violent crimes," Bukunt said. "Clearly, there are serious issues involving this juvenile." He said the state Division for Children, Youth and Families is involved in the case.

Bukunt said the dog, which is not owned by the boy, was injured on Nov. 25. The child offered to take the 13-year-old Doberman for a walk. The owner, Bukunt said, had no idea that the boy intended to take it to the Whitney Street area to get it to fight a pit bull.

When the Doberman refused to fight the other dog, Bukunt said the boy kicked it in the abdomen and back several times, injuring the dog's spine.

The child then returned the dog to its owner who noticed it could not rest on its stomach. The owner, Bukunt said, believed it was because of some other medical condition. The dog is recovering from the injury , Bukunt said.

The owner was not aware that her dog had been physically abused until this month when another neighborhood child told her what happened. She called police.

The assault on the 10-year-old girl happened on Dec. 27. Bukunt said the boy, who lives in the same French Hill neighborhood as the 10-year-old girl, learned that she and a friend had earned money shoveling snow.

He followed the girl after she finished and had been paid, pushed her down into a snowbank, put his foot on her back and began rifling through her pockets, according to Bukunt. The other girl saw what was happening and went to help her friend and the boy ran off.

He is charged with being a delinquent child for robbery and cruelty to animals charges, both class B felonies. He was also charged with disorderly conduct at the Elm Street Middle School.

The boy is scheduled for a juvenile hearing this morning at Nashua District Court.
