Thomas Cox was allowed to remain free on his own recognizance after he pleaded not guilty today to animal fighting and animal cruelty charges before acting Erie County Judge Thomas P. Amodeo for alleged animal fighting at his A Street home last summer.
Cox, 41, declined to comment following his arraignment on the indictment. Erie County District Attorney Frank A. Sedita III said Cox was charged with staging illegal animal fights at his home at 25 A St. last Aug. 24.
The SPCA Serving Erie County seized five dogs from the home.
Sedita said several of those dogs had to be put down due to the severity of injuries they suffered or due to their aggressive behavior toward SPCA and city shelter workers.
If convicted, Cox faces a prison term of up to four years.
Amodeo scheduled further proceedings in the case for April 21.
Case UpdatesThomas Cox began a one-year jail term Tuesday on his guilty plea to reduced charges of promoting animal fighting at his former A Street home in the summer of 2008.
After citing Cox’s somewhat lengthy criminal record, Erie County Judge Thomas P. Amodeo had him taken into custody and questioned his sincerity.
Cox, 42, now of Mills Street, pleaded guilty Nov. 10 to misdemeanor dog fighting charges. He had been indicted on felony-level dog fighting charges.
Prosecutor Alyson C. Culliton said the four pit bulls and a German shepherd Cox was using had to be “put down,” the pit bulls because of extensive injuries and the German shepherd for its aggressiveness.
