A complaint about animal cruelty led police to allegedly discover three children left in the care of a heavily intoxicated man.

According to police reports, a complaint was filed after a man was seen kicking and shaking a small brown dog in the 800 block of Berlin Avenue.

A police officer went to the home about 6:30 p.m. Monday and reported arriving as a man threw the dog by the neck out the front door and onto the sidewalk.

The officer tried to approach the dog, but the animal yelped and limped away from him, police said. He then approached the home and tried to talk with the homeowner, but the man refused to leave the home.

The man eventually left the home, however, and police entered to find three children - ages 2, 2 and 10 - and no other adults. Officers also reported finding several alcohol bottles, including an empty vodka bottle on the floor, within easy reach of the children. No other adults were at the home.

Police said the 31-year-old man smelled of alcohol, and a portable breath test showed the man had a blood-alcohol level of 0.26 percent, more than three times the legal driving limit.

Police arrested the man, accusing him of child neglect and animal torture, before taking him to the emergency room. The man refused medical treatment, however, and was taken to the St. Joseph County Jail.

The children were placed in the custody of relatives.
