A Centralia man accused of kicking or stomping his live-in girlfriend so hard she nearly died of internal injuries was in court on Thursday facing charges of second-degree assault.
Kyle E. Wagar, 27, vanished after the July incident, but recently was returned to Lewis County from Nevada.
Wagar's parents and the girlfriend were in the audience in Lewis County Superior Court. He was expected to make his pleas, but didn't have an attorney.
Shackled at his waist and feet, the Centralia man asked Judge James Lawler if he could request a particular lawyer. The judge said no. Lawler found Wagar qualified for a court-appointed attorney, and decided upon Chehalis attorney Ken Johnson. Wagar is being held on $100,000 bail.
The alleged victim said after the brief hearing that Centralia police are liars and Wagar didn't do it.
"It's bull****," she said outside the Chehalis courtroom.
Police were called on July 8 to Providence Centralia Hospital where Brianna Kazee underwent emergency surgery for what charging documents called a severed spleen and a punctured lung caused by a broken rib.
She told a nurse she tripped over her dogs.
Police detective Carl Buster interviewed Kazee's sister, who said Kazee had given her a somewhat different story. Kazee told Buster the same thing, then later corroborated what her sister had claimed, according to charging documents.
Charging documents allege Kazee was getting ready for work when she heard her dog yelping and saw Wagar had it cornered in the kitchen and was kicking it.
He pushed her away, touched the stove and burned his hand, and then knocked Kazee to the ground, kicking her, charging documents allege.
He took her to the hospital, told her he was sorry, that he blacked out, that he loved her, then left, according to police.
The doctor who operated on Kazee told police she was bleeding to death when she arrived at the emergency room, and if she had waited two more hours, would have died.
Wagar is also charged with second-degree animal cruelty.
