A Logan Square man was charged with aggravated animal cruelty Tuesday after he flung a 2-month old calico kitten from a second-story porch because he said it had scratched him, authorities said.

The kitten suffered a broken pelvis.

Wayne Evans, 49, of the 3700 block of West Dickens Avenue was arrested Monday after police responding to a call of animal abuse found the kitten lying in the street, bleeding from its mouth and unable to move its hind legs, police said. Witnesses said they saw Evans hold the kitten by the back of the neck and throw it.

The domesticated female kitten was turned over to Animal Care and Control, where an officer said Tuesday that the kitten, which is unnamed but probably will be given a nickname by officers, is expected to recover.

"This cat is a sweetheart, she really is," an animal control officer said. "As much pain as she was in last night-and this makes me question his [Evans'] story-as much pain as she was in, she did not try to scratch us. She only wanted to be held."

The kitten will be used as evidence, and the officer said it was unclear whether Evans would be charged for the animal's medical care. He has not signed over ownership of the kitten, the officer said, though police said he had.

Reached by telephone, a woman who said she was Evans' wife declined to comment.

Evans is scheduled to appear Wednesday in Bond Court on the felony charge.
