Two Owasso residents were charged in Tulsa County District Court late last week from an animal cruelty incident that involved two dogs, one of which died.

Brandon Jay Deatherage was charged with one count of animal cruelty and Lyndsay Elaine Hurst was charged with conspiracy as a result of the incident. The case was filed in Tulsa County District Court on Thursday, July 24.

The animal cruelty charge is punishable with either five years in the state penitentiary for one year in the county jail or a fine of $5,000.

According to a report filed by the Owasso Police Department, police were called to the home of Barrington Malcolm just north of German Corner at approximately 11:20 p.m. on Monday, June 30.

Malcom told police that he had gone outside to check on his telephone line when he noticed that his female Shar Pei dog had an arrow through its body and it looked as if the male Shar Pei dog had been poisoned.

The report stated that both dogs were taken to the Animal Emergency Center in Tulsa. The male dog was pronounced dead on arrival and it was revealed by an X-ray that the male dog had a .22 caliber bullet lodged inside his chest cavity. The female dog was operated on and the arrow was removed and survived.

A report filed by Owasso police on Tuesday, July 1, said that Owasso police spoke to Hurst, Barrington's neighbor. Hurst told police that both dogs came into her yard through a hole in the fence.

Hurst also told police that during one of the times the dogs got into her yard, she called her husband, who was out of town. Hurst told police that she went to Deatherage's house to ask for help. Hurst told police that Deatherage got his bow and arrow, walked down to Hurst's house and shot the dogs.

The report stated that police went to Deatherage's house where Deatherage was read his rights and that he stated he did not want to make a statement.

As police were leaving Deatherage's property, Deatherage said that he was just helping a friend.
